Liability Waiver & Assumption of Risk Agreement

I, and as parent or legal guardian of the child (or children) whose name is set forth below (each referred to as a “Participant” and collectively referred to herein as the “Participants”) and in consideration of the Participants being permitted to participate in the Activities (defined below) at Baby University LLC (“Baby University”), agree as follows:

1. Activities

“Activities” may include any and all services, programs, events, and use of the facility offered by Baby University, including but not limited to indoor playground use, open play, classes, workshops, birthday parties, events, sensory activities, movement activities, educational presentations, parent programming, and any related participation within the facility.

2. Assumption of Risk

I understand that participation in Activities at Baby University involves inherent risks of injury and illness.

These risks may include, but are not limited to:

  • Falls
  • Slips and trips
  • Collisions with equipment or other participants
  • Choking hazards
  • Allergic reactions
  • Physical exertion
  • Injuries resulting from the actions of other participants
  • Exposure to contagious illnesses
  • Property damage
  • Serious injury or death

I understand that, Baby University cannot eliminate all risks or guarantee the safety of the Participants while Participants participate in the Activities. I have made my own investigation of these risks, understand these risks, and assume them knowingly and willingly on behalf of myself and my minor Participant child.  Notwithstanding these risks and other hazards that may be foreseeable but not specifically identified herein, I, for myself and any minor Participant child, and our respective heirs, personal representatives and assigns, understand, acknowledge, and expressly and voluntarily assume all risks and full responsibility for any sickness or injury arising out of or related to the Activities.

3. Facility Rules & Safety Policies

I, and any children under my care, understand and agree to follow all Baby University safety rules, policies, and play guidelines, including those posted within the facility or on Baby University’s website.

I acknowledge that these rules and guidelines may be updated, modified, or changed at any time and that it is my responsibility to review and follow current policies prior to participating in Activities or using the facility.

Baby University reserves the right to remove any participant who does not follow facility rules (that are listed on the Baby University website) or whose behavior may create an unsafe environment for others.

Rules are subject to change, and Participants are responsible for reviewing the Website for any changes or updates.

4. Parent/Guardian Supervision Responsibility

I understand that Baby University employees, teachers, contractors, and providers are not responsible for supervising children utilizing the facility unless explicitly stated for a designated drop-off program.

I acknowledge that I am solely responsible for supervising all minors under my care at all times while using the facility, including during open play, classes, events, birthday parties, workshops, and all other Activities.

5. Release of Liability

To the fullest extent permitted by law, I release, waive, and hold harmless Baby University LLC, its owners, members, employees, contractors, teachers, providers, volunteers, affiliates, and landlords from any and all liability, claims, demands, damages, injuries, losses, expenses, or causes of action arising out of or related to participation in Activities or use of the facility.

This release includes, but is not limited to, claims arising from personal injury, illness, property damage, disability, or death, whether caused by negligence or otherwise, except in cases of gross negligence or willful misconduct.

To the fullest extent permitted by law, Baby University’s total liability arising out of or related to participation in Activities, use of the facility, or this Agreement shall not exceed the total amount paid by Participant to Baby University within the twelve (12) months preceding the event giving rise to the claim.

6. Security Cameras

For the safety and security of guests, employees, and the facility, Baby University may utilize video surveillance and security cameras throughout portions of the premises.

By entering the facility and participating in Activities, Participant acknowledges and consents to video recording for safety, security, operational, and incident documentation purposes.

7. Photo & Video Release for Marketing

Participant grants Baby University permission to photograph and/or record Participant and any minor child(ren) under their care while participating in Activities, classes, events, or while using the facility.

Participant understands and agrees that these photographs, videos, and recordings may be used by Baby University for marketing, advertising, promotional, educational, website, and social media purposes without compensation.

Baby University will make reasonable efforts to use images respectfully and appropriately in alignment with the family-friendly nature of the business.

If Participant does not wish for themselves or their child(ren) to appear in marketing materials, Participant must notify Baby University in writing prior to participation, and Baby University will make reasonable efforts to honor such requests.

All photographs, videos, recordings, promotional materials, and related content created by or for Baby University shall remain the property of Baby University and may be used for lawful business and promotional purposes.

8. Educational Programming & Medical Disclaimer

I understand that Baby University may offer classes, workshops, consultations, support groups, and educational programming led by licensed, certified, or otherwise qualified professionals.

I acknowledge and agree that all information, demonstrations, discussions, and materials provided by Baby University or its providers are intended solely for general educational and informational purposes.

Participation in Activities does not establish a medical, therapeutic, mental health, or provider-patient relationship and does not replace individualized medical advice, diagnosis, treatment, or care from a qualified healthcare professional.

I understand that Baby University and its providers are not responsible for decisions, outcomes, injuries, or conditions arising from reliance on information shared during Activities.

9. Independent Providers

Certain classes, workshops, or services at Baby University may be provided by independent contractors or third-party professionals. Participation in such Activities is voluntary, and Baby University is not liable for the actions, recommendations, services, or conduct of independent providers.

10. Illness & COVID-19 Warning

I understand that participation in Activities and use of the facility involves exposure to public spaces where contagious illnesses may be present, including but not limited to COVID-19, influenza, RSV, and other communicable diseases.

COVID-19 is an extremely contagious disease that may lead to severe illness or death, particularly for individuals with underlying health conditions.

I voluntarily assume all risks related to exposure to illness while participating in Activities at Baby University.

I agree not to enter the facility if I or any child under my care is experiencing symptoms of illness including fever, vomiting, diarrhea, or other contagious symptoms.

Baby University makes no guarantees regarding exposure prevention and shall not be held liable for illness or disease resulting from participation in Activities or use of the facility.

11. Participation in Physical Activities

I understand that certain Activities may involve movement, climbing, exercise, sensory experiences, gross motor play, yoga, music and movement, and other physical activities.

I affirm that I and/or my child(ren) are physically able to participate and voluntarily assume all risks associated with participation.

12. Property Damage & Personal Belongings

Baby University is not responsible for lost, stolen, or damaged personal belongings brought onto the premises.

I agree to be financially responsible for any intentional or reckless damage caused by myself or any child under my care to Baby University property, equipment, or materials.

13. Emergency Situations & Medical Care

In the event of an injury, medical concern, or emergency involving myself or any child under my care, I authorize Baby University staff to contact emergency services and take reasonable action to assist until emergency personnel arrive.

I understand that Baby University does not provide medical care and that I remain responsible for all medical decisions and expenses incurred as a result of emergency treatment or transportation.

14. Continuing Waiver & Agreement

I understand and agree that this Liability Waiver & Assumption of Risk Agreement is ongoing and applies to all current and future visits, participation in Activities, events, programs, and use of the facility by myself and any minor child(ren) under my care unless revoked in writing by Baby University.

This agreement shall remain fully effective for all future participation and facility use without requiring a new waiver to be signed for each visit.

15. Authority to Sign

I certify that I am the parent or legal guardian of the minor child(ren) listed below or otherwise have legal authority to sign this agreement on their behalf.

I acknowledge that I have carefully read and fully understand this Liability Waiver & Assumption of Risk Agreement and voluntarily agree to all terms contained herein.

16. Governing Law & Venue

This Agreement shall be governed by and interpreted under the laws of the State of Colorado.

Any dispute arising out of or related to this Agreement or participation in Activities at Baby University shall be brought exclusively in a court of competent jurisdiction located in Colorado.

17. Severability

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
